Varsity Tutors Scholarship Promotion – Subject to Official Rules

Varsity Tutors Scholarship Promotion – Official Rules

OFFICIAL RULES. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO individuals who are at least 16 years of age on or before their entry into the Promotion (defined below). Such individuals must be a legal resident of one of the fifty United States or the District of Columbia as of April 01, 2024. VOID WHERE PROHIBITED BY LAW. THE ACT OF ENTERING THIS PROMOTION CONSTITUTES ACCEPTANCE OF THE RULES AS CONTAINED HEREIN AND OF THE DECISIONS OF SPONSOR, WHICH ARE FINAL AND BINDING IN ALL RESPECTS.

1.PROMOTION PERIOD: The entry period for the Varsity Tutors Scholarship Promotion (the “Promotion”) begins on April 01, 2024, at 12:00 AM CDT (the “Promotion Start Date”) and ends on April 30, 2024 at 11:59 PM CDT (the “Promotion End Date”) (collectively, the “Promotion Period”). Prizes have limited promotional entry, ending, and selection periods as noted below.

2.PROMOTION DESCRIPTION: The Promotion is a skill-based promotion, the object of which is to provide your best possible answer to the question posted on https://www.varsitytutors.com/college-scholarship for the Promotion Period (each, a “Submission”). Each Submission must adhere to the following standards:

  • The text must exceed 200 words and must not exceed 900 words.
  • All essays must address the specific promotion question presented during Promotion Period, must be original, must not have been previously published, released, or distributed, and must have been created and must be owned exclusively by you. Publication of your essay must not violate any legal obligations that you have or the legal rights of any third party. Once submitted by you, Sponsor may post your submission on a publicly accessible web site or disseminate your submission through print and broadcast media either during or following the contest. Sponsor disclaims any and all liability for any infringement of any third parties' rights in any submission caused by you.
  • Content must not be of an offensive, explicit, negative, or controversial nature.
  • Essay must follow an organized, multiple-paragraph format.
  • Essay must exhibit the standard rules of grammar & mechanics.

3.HOW TO ENTER: Only one entry per person will be eligible during the Promotion Period. Entry dates for the Promotion Period commence at 12:00 AM CDT on the Promotion Start Date and close at 5:00 PM CDT on April 15, 2024 (the “Promotion Entry End Date”) (collectively, the “Promotion Entry Period”). Any attempt by a participant to enter more than once during the Promotion Entry Period may result in disqualification of all entries submitted by that participant for the entire Promotion Period. Internet Entry Method: Participants may enter this Promotion during the Promotion Entry Period via the Internet by logging on to https://www.varsitytutors.com/college-scholarship and providing all required information. All Internet entries must be submitted and received before the Promotion Entry End Date to be considered for any prize drawings. Mail-in Entry Method: Participants may enter this Promotion during the Promotion Entry Period via mail by mailing their essay along with required contact information to Marketing Department, Varsity Tutors Scholarship Promotion, 101 South Hanley Road, Suite 300, Clayton, MO 63105. Essays must be received in the mail before the Promotion Entry Period ends. Each submission must not contain copyrighted materials or any other materials that may be restricted, prohibited, or outlawed by federal, state, or local laws.

4.JUDGING AND AWARDING OF PRIZE: JUDGING. One Grand Prize Winner will be chosen from all eligible submissions received during the Promotion Entry Period in two (2) rounds as follows: Round 1 (online voting) – Selected entries submitted during the Promotion Entry Period meeting Varsity Tutors’ minimum submission criteria and that are selected by Sponsor at Sponsor’s sole discretion, will be posted at https://www.varsitytutors.com/college-scholarship within 2 days of the Promotion Entry End Date, and visitors to the Varsity Tutors site will be invited to vote for eligible entries received and posted for Round 1 to be selected for Round 2. Eligible entries for Round 1 shall be posted at https://www.varsitytutors.com/college-scholarship and voting shall be in accordance with the instructions posted by Sponsor. Voting will be enabled and allowed beginning at 5:00 PM CDT on April 15, 2024 (the “Voting Period Start Date”) and end at 11:59 PM CDT on April 30, 2024 (the “Voting Period End Date”) (collectively, the “Voting Period”). The top 5 eligible entries receiving the most online votes during the Voting Period will be elected for Round 2. Online votes during the Voting Period are unlimited. Round 2 (Sponsor judging) – The top 5 eligible entries selected during Round 1 will be judged by a panel of judges selected by Sponsor (including Sponsor’s employees) based upon the following criteria in the following percentage values of each criteria:

  • Clarity of expression: 25%
  • Creativity: 25%
  • Originality of expression: 25%
  • Sincerity: 25%

The decisions of the judges are final and fully discretionary. In the event of any tie scores during judging for Round 2 of the Promotion, the score on creativity will be used to break the tie. If the creativity scores are also tied, the tying contestants will split the prize evenly. Varsity Tutors is not responsible for internet service outages, delays, equipment malfunctions, and any other technological difficulties that may prevent an individual from completing an online vote. Internet votes will be deemed made by the authorized account holder of the IP address submitted at the time of voting. The authorized account holder is the natural person who is assigned to the IP address by an internet access provider, online service provider, or other organization that is responsible for assigning an IP address or the domain associated with the submitted IP address. Use of any device to automate voting is prohibited. Proof of submission of a vote shall not be deemed proof of receipt by Sponsor. Sponsor’s computer is the official time keeping device for the Promotion. The Sponsor is not responsible for votes not received due to difficulty accessing the internet, service outage or delays, computer difficulties, and other technological problems. The finalist receiving the most combined total online votes during Round 1 and the highest overall score during Round 2 (including any tie-breakers) during the Promotion will be deemed the Grand Prize winner for Promotion Period. The judges will announce the Grand Prize Winner from among all of the eligible entries within seven (7) business days after the Promotion End Date (the “Winner Selection Date”). All judging is conducted under the supervision of the Sponsor whose decisions are final in all matters relating to the Promotion. Odds of winning depend on the total number of eligible entries received.

5.PRIZES: One (1) Grand Prize per Promotion Period equal to $200 Scholarship shall be awarded for the Promotion Period. The total value of all prizes to be given away is $200. No substitution, cash equivalent, transfer, or assignment of the Grand Prize is permitted except at the sole discretion of Sponsor, who reserves the right to substitute a prize of equal or greater value in the event a prize is unavailable for any reason. Winners are responsible for payment of all federal, state, and local taxes on the Grand Prize and for any other expenses associated with the Grand Prize not specifically described herein. Except where prohibited by law, each potential winner will be awarded his or her prize only after such winner’s eligibility has been verified and such potential winner has completed (1) a statement of eligibility, (2) a liability and publicity release (unless prohibited by law), and (3) any other documentation reasonably requested by Sponsor. Failure by the potential winner to return such executed documents (including the publicity release described below) within ten (10) days after request by the Sponsor may result in disqualification of the potential winner. The Grand Prize shall be made payable to the individual winner (or parent or legal guardian), and is intended for use during the 2023/2024 school year to an accredited college, university, or other institution of higher learning in the United States.

6.ELIGIBILITY: Eligibility is limited to individuals who are at least 16 years of age on or before their entry into the Promotion. Such individuals must be a legal resident of one of the fifty United States or the District of Columbia as of April 01, 2024. Directors, officers, and employees of Sponsor or its agents, affiliates, subsidiary and parent companies, distributors, contractors, advertising and promotion agencies, and members of immediate families or households of any of the foregoing persons are not eligible. Previous winners of Promotion may not enter again. The Promotion is subject to all federal, state, and local laws and is void where prohibited by law. Any person that is otherwise prohibited by contract, law, or other rule from participating in contests of a nature similar to the Promotion is not eligible to win any prizes in conjunction with the Promotion. By participating, participants agree to be bound by these Official Rules and to accept the decisions of the Sponsor as final in all matters relating to this Promotion.

7.NOTIFICATION: Winner will be notified via email (or if no email address is provided, by telephone) on or before the Winner Selection Date. Failure by potential winner to respond to such notification within ten (10) days after Sponsor’s first attempt, failure by the potential winner to adhere to these Official Rules, or the return of the Grand Prize as undeliverable will result in disqualification of the potential winner and an alternate winner will be selected.

8.DISCLAIMER: The Sponsor is not responsible for typographical or other errors in the printing, the offering, or the administration of the Promotion, or in the announcement of prizes. The Sponsor is not responsible for lost, late, misdirected, undeliverable, or incomplete entries due to system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, or faulty transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or providers, computer equipment, or entries not received on account of technical problems or traffic congestion on the Internet, or at a web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from entering the Promotion or downloading any material for the Promotion, or other telecommunications malfunctions which may limit an participant’s ability to participate.

9.LIMITATION OF LIABILITY AND INDEMNIFICATION. Except where prohibited by law, Promotion participants hereby release from all liability, loss, damage, or injury resulting from, and agree to indemnify, defend, and hold harmless Sponsor and its parents, companies, subsidiaries, affiliates, directors, officers, managers, members, employees, and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of (i) participant’s participation in the Promotion; (ii) the receipt or use of any prize awarded, or (iii) use of any information or materials provided by participant to Sponsor for purposes of this Promotion (including, without limitation, submission of and Sponsor’s use of participant’s Submission). Prizes are awarded “AS-IS,” and Sponsor, and its employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, guarantee, express or implied, in fact or in law, relative to any prize including, but not limited to, its quality, condition, or fitness for a particular purpose. Sponsor is not responsible for and shall not be liable for lost, late, delayed, incomplete, unreadable, garbled, inaccurate, or erroneously transmitted Submissions or information provided by Promotion participants.

10.MODIFICATION AND TERMINATION: In the event the Promotion is compromised by unauthorized human intervention, tampering, mechanical or electronic failures, or other causes beyond the reasonable control of the Sponsor, which corrupt or impair the administration, security, fairness, or proper operation of the Promotion, the Sponsor reserves the right, but not the obligation, in its sole discretion to void any entries submitted fraudulently or to suspend, modify or terminate the Promotion, in which case the Sponsor shall not be required to award any prize or substitute prize. The Sponsor will prosecute any and all fraudulent activities to the fullest extent of the law.

11.ADDITIONAL PROMOTION CONDITIONS: Each Grand Prize winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Sponsor in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the Grand Prize. Such winnings of $600 or more will be reported to the IRS. By participating in the Promotion, each participant assigns ownership of his or her Submission to Sponsor, including all rights to print, publish, broadcast, edit and use, worldwide in any media now known or hereafter developed, at any time or times, such Submission. Winning participants hereby grant Sponsor and its licensees, affiliates and assigns the right to print, publish, broadcast, edit and use, worldwide in any media now known or hereafter developed, their respective names, portraits, pictures, voices, likenesses and biographical information as news or information and for advertising and promotional purposes relating to this Promotion and Sponsor’s products or services without additional financial or other compensation, unless prohibited by law. By providing information to Sponsor pursuant to this Promotion, each participant consents to Sponsor’s use of such information for promotional or any other purposes allowed by law. Each participant also represents and warrants that any and all materials submitted for entry into this Promotion are such participant’s own, that such participant owns all rights, interest, and title to any and all such materials, and that participant has secured any necessary consents or waivers from third parties relating to such materials. Winners must sign a publicity release confirming such consent prior to acceptance of the Grand Prize unless prohibited by law. Winners further agree to appear for any presentation or other activity which may include filming, audio, video, electronic or other recordings and/or interviews as may be determined from time to time by the Sponsor, unless prohibited by law. By providing information pursuant to this Promotion, the participant consents to the Sponsor’s use of such information for promotional or any other purposes allowed by law.

13.SPONSOR: Varsity Tutors LLC. Sponsor reserves the right to modify or end the Promotion at any time.
